The nature of charitable trusts means that the definition of "public benefit" varies between Macnaghten's four categories. This includes following the law and recognised standards, protecting charities from undue risk, and showing respect for donors, supporters and the public. The standard categorisation (since every single past endeavor to put it on the statute books were "unduly lumbering") was set out by Lord Macnaghten in IRC v Pemsel, where he said that "Philanthropy in its legitimate sense includes four essential divisions: Trusts for the alleviation of destitution; trusts for the progression of training; trusts for the headway of religion; and trusts for different purposes gainful to the group".

A few foundations are 'excepted' from philanthropy enlistment.
